These Terms and Conditions ("Terms") govern your access to the TradePhantom website, public materials, private research workflows, intelligence systems, and any member or Team platform operated by TradePhantom LLC ("TradePhantom," "we," "us," or "our"). By accessing or using any TradePhantom service, you agree to these Terms.

1. Nature of TradePhantom

TradePhantom operates as a proprietary market intelligence and systematic execution research desk. We develop research workflows, intelligence systems, and private operational tools for futures and options-driven markets. TradePhantom is not a public signal marketplace, broker, investment adviser, investment manager, trading school, or copy-trading service.

2. Informational and Research Use

All TradePhantom materials, research outputs, platform data, and communications are provided for informational, research, and operational workflow purposes only. They do not constitute financial, investment, legal, tax, or accounting advice. You are solely responsible for your own trading, investment, risk-management, and operational decisions.

3. Private Access

Access to proprietary intelligence, research workflows, private Team infrastructure, or member platforms may be limited, selective, and subject to additional agreements, verification, or operational requirements. TradePhantom may approve, deny, suspend, or terminate access at its discretion where appropriate.

4. Accounts and Security

If you receive access to a private TradePhantom platform, you are responsible for maintaining credential confidentiality, securing your own devices, and promptly reporting unauthorized access. You may not share accounts, credentials, private materials, uploads, exports, or internal platform data without written authorization.

5. Member and Team Platform Data

Team members or authorized users may upload trading-session records, screenshots, CSV files, logs, account labels, operational metrics, and related review data. You represent that you have the right to submit the data you upload and that submitted information is accurate to the best of your knowledge.

6. Fees and Private Agreements

Any paid access, private arrangement, Team participation, partner engagement, or operational agreement will be governed by the applicable written terms presented for that relationship. Public website access alone does not create any entitlement to proprietary intelligence, private systems, Team participation, or partner workflows.

7. Intellectual Property

TradePhantom methodologies, software, designs, text, graphics, research processes, intelligence workflows, data structures, analyses, and platform features are the property of TradePhantom LLC or its licensors. You may not copy, redistribute, reverse engineer, scrape, resell, publish, or create derivative works from TradePhantom materials without written authorization.

8. Prohibited Uses

You agree not to:

• Use TradePhantom materials for unlawful, misleading, abusive, or unauthorized purposes.
• Represent TradePhantom research as financial advice, guaranteed outcomes, or public trading signals.
• Attempt to bypass authentication, authorization, platform controls, or upload restrictions.
• Upload malicious files, false data, unauthorized third-party data, or sensitive credentials.
• Share private platform access or confidential operational materials without permission.

9. Trading and Market Risk

Trading futures, options, equities, currencies, digital assets, or other financial instruments involves substantial risk of loss and may not be suitable for every person or entity. Market research can be incomplete, delayed, wrong, or invalidated by changing conditions. Past examples, research observations, or internal analysis are not guarantees of future results.

10. Third-Party Services

TradePhantom may reference, integrate with, or receive data from third-party platforms, including market-data providers, payment processors, communication tools, hosting providers, or trading-platform export files. Third-party services are governed by their own terms and policies. TradePhantom is not responsible for third-party outages, errors, data changes, or policies.

11. No Warranty

TradePhantom services and materials are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that any research, platform, file parser, upload workflow, analysis, or operational output will be uninterrupted, error-free, complete, current, or suitable for a specific purpose.

12. Limitation of Liability

To the maximum extent permitted by law, TradePhantom LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including trading losses, lost profits, lost data, business interruption, or damages arising from use of or reliance on TradePhantom materials or platforms.

13. Changes to These Terms

We may update these Terms from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of TradePhantom services after changes are posted constitutes acceptance of the updated Terms.
